Special Council Meeting
March 6, 2008

The meeting was called to order by Mayor Virginia Carnes at 6:00 PM. Council members present were George Hall, Lorin Newberry, John Standley and Shawna Kirk. Also present were City Recorder Jackie Carey, Officer Doug Lane Sgt. Jan Good and Jim Carey.

 Mayor Carnes advised Nancy Lankford is sick and Andrew Mentzer had an emergency and couldn’t be here.
 
POLICY & PROCEDURES
 

Hall stated we are only here to discuss the policy and procedures concerning Chris Tiboni.

Kirk said if the officers are working their lunch breaks than they should be paid if they are expected to listen to their radios. Standley read page 47 & 48 of the BOLI manual regarding lunch breaks.
Hall stated it is real simple if you expect an officer to listen to their radio then they are not relieved of duty.
Carey asked Sgt. Good if an officer is scheduled for a 10 hour shift, then their lunch hour is already paid. Sgt. Good stated yes.
Officer Lane wanted to clarify one thing, the Council is not only dealing with Tiboni, but Officer Lane also wants to be paid and maybe Mark Ashcraft. Hall stated the Council isn’t excluding anyone.
Sgt. Good stated this issue can be resolved simply by him not paying the contract and he will not ask for the time he has not been paid for.
Standley stated he feels comfortable with going with his motion at the last meeting in regards to paying for lunch hours from that date forward. Standley would like a legal opinion on how far you have to go back.
Jackie Carey asked about when the officers were under the Umatilla County Sheriff’s Office policy and procedures. Sgt. Good stated they were the same, they pay for lunch hours.
Hall suggested contacting CIS attorney Kirk Mylander. The people that will do a conference call to Mylander will be Kirk, Standley, Newberry,
Carey and Good. Standley said we need to contact CIS tomorrow.
 
Hall stated the following:
 
          1.       Tiboni terminates early
         
          2.       He signed an employment contract

          3.       Past money due, policy states they get paid for lunch breaks

          4.       Personnel
         
          5.       Tiboni would like everything to go away

          6.       How far does the City go back on paying for lunch breaks?

 

Hall would like to resolve this issue with the least amount of conflict.

 
POLL
 

Hall advised that Kim Bedard was able to get an extension on the DEQ issue until April 4th. Newberry, Hall and Draper will work on this issue.

 EXECUTIVE SESSION
 

The Council went into executive session under ORS 192.660 (2)(h) Legal Counsel; Employment Agreement at 6:50 PM and came out at 8:10 PM.

 OTHER BUSINESS
 

Jim Carey addressed the Council regarding some concerns regarding his wife, Jackie Carey.

On a motion by Hall and seconded by Kirk the Council decided to contact the city attorney tomorrow to assist in the fairest resolution of the Tiboni issues. All members present voted yes.

Mayor Carnes stated as of tomorrow we have no supervision of the police department. Carnes, Good, Sheriff Trumbo and Lt. Diehl met yesterday regarding the Sheriff’s Office supervising the City’s police department.   The Sheriff’s Office will respond in case of 911 emergencies if no officer is available. There will be no ordinance enforcement. Officer Lane can call Lt. Diehl, Sheriff Trumbo or Undersheriff Rowan if he has any questions. Trumbo stated only schedule Lane for an 8 hour period and then a supervisor has to ok any overtime.

 
Good has some concerns about the evidence locker. Good is uncomfortable with Lane handling it by himself. Good will contract with the City until the Chief is hired for 3 hrs a week to work on the evidence locker. On a motion by Standley and seconded by Hall the Council hired Jan Good to be the evidence locker technician and clean the evidence locker for 3 hrs a week at a cost of $20 per hour. All members present voted yes.
 
We need to have Tim Britain make the file cabinet in the police department lockable. On a motion by Hall and seconded by Kirk the Council approved fixing or purchasing a lockable file cabinet for the police department. All members present voted yes.
Hall stated as long as the executive tapes are kept separate from the regular tapes he does not have a problem with them not being in an envelope.
 
ADJOURNMENT
 

On a motion by Hall and seconded by Kirk the meeting was adjourned at 9:50 PM. All members present voted yes.
