ARTICLE 13. INTERPRETATION AND ENFORCEMENT

13.10 Interpretation.

Words used in the present tense include the future, the singular form includes the plural, and plural includes the singular. Where a provision of this Ordinance is less restrictive than a provision of another ordinance or requirement of the City, the provision which is more restrictive shall govern.

13.20 Authorization of Similar Uses.

The City Council may rule that a use not specifically listed among the allowed uses in a zone shall be permitted as an allowed use, if it is similar to the allowed uses in the zone, if its effect on adjacent properties is substantially the same as that of allowed uses, and if it is not specifically listed as an allowed use in another zone.

13.30 Penalty.

A person violating a provision of this Ordinance shall, upon conviction, pay the City Attorney's fees incurred and a fine of not more than $1,000.00. A violation of this Ordinance shall be considered a separate offense for each day that the violation continues. In the alternative, where a use exists or is proposed to be located, constructed, repaired, altered or used in violation of this Ordinance, the City may institute injunction, abatement or other appropriate proceedings to prevent, abate or remove such use.

13.40 Severability.

The provisions of this Ordinance are severable. If an article, sentence, clause or phrase shall be adjudged by a court of competent jurisdiction to be invalid the decision shall not affect the validity of the remaining portions of this Ordinance.

Emergency Clause.

Inasmuch as it is necessary for the health, peace and safety of the inhabitants of the City of Pilot Rock that this ordinance have immediate effect, an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage by the Council and approval of the Mayor.
